Terms of Service

1.Acceptance of Terms

By downloading, installing, or using the SPOT mobile application or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms. We will notify you of material changes through the App or by email.

2.Who Can Use SPOT

You must be at least 13 years old (or 16 in the EEA) to use SPOT. By using the Service, you represent that you meet this age requirement. If you are using SPOT on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3.Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

  • ·Provide accurate and complete information when creating your account
  • ·Keep your password secure and not share it with others
  • ·Notify us immediately at thewolf359project@gmail.com if you suspect unauthorized access to your account
  • ·Not create accounts using automated means or under false pretenses

We reserve the right to suspend or terminate accounts that violate these Terms.

4.Content and Conduct

SPOT allows you to submit food spot nominations, reviews, photos, and other content ("User Content"). You retain ownership of your User Content, but by submitting it you grant SPOT a worldwide, non-exclusive, royalty-free license to display, distribute, and promote it within the Service.

You agree not to submit content that:

  • ·Is false, misleading, or fraudulent
  • ·Infringes any third party's intellectual property or privacy rights
  • ·Is defamatory, harassing, abusive, or discriminatory
  • ·Contains spam, commercial solicitation, or promotional material not authorized by SPOT
  • ·Violates any applicable law or regulation

We reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, is otherwise objectionable.

5.Spotters and Recommendations

SPOT is built on the credibility of its Spotters — the people who submit recommendations. By submitting a food spot or review, you represent that:

  • ·You have personally visited or have direct knowledge of the place
  • ·Your recommendation reflects your genuine, uncompensated opinion
  • ·You have not received payment, free meals, or other incentives from the establishment in exchange for your recommendation

SPOT does not endorse, verify, or guarantee the accuracy of any user-submitted content. Recommendations reflect the views of individual Spotters, not SPOT.

6.Intellectual Property

All content, design, code, trademarks, and logos created by SPOT — excluding User Content — are owned by SPOT and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from SPOT's proprietary content without our express written permission.

The SPOT name, wordmark, and "Eat like you mean it." tagline are trademarks of SPOT. Nothing in these Terms grants you a right to use them.

7.Third-Party Services

The Service integrates with third-party platforms and services including Apple, Google, Meta, Supabase, and Expo. Your use of those services is subject to their respective terms and privacy policies. SPOT is not responsible for the content, availability, or practices of any third-party service.

8.Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Restaurant information, hours, and availability may change. SPOT does not guarantee that any listed place is currently open, accurately described, or consistent with the experience described by Spotters.

9.Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the greater of (a) the amount you paid to use the Service in the 12 months preceding the claim, or (b) $100 USD.

10.Termination

You may stop using SPOT and delete your account at any time within the App. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our discretion.

Upon termination, your right to use the Service ceases immediately. Sections 6, 8, 9, and 11 survive termination.

11.Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in California, and you consent to personal jurisdiction in those courts.
